Supreme Court grants petition in City of Killeen case

The Supreme Court on Friday granted the petition of the plaintiffs in Worsdale v. City of Killeen. The case involves a motocycle wreck on a road that the City erroneously believed was either a county road or had been returned to the adjacent land owners. The question involves notice of fault. The plaintiffs allege that the City knew of all of the facts in the case, and therefore had notice. Alternatively, if the court of appeals properly applied the Cathey standards, the plaintiff urges that the Supreme Court overrule Cathey. Oral argument is set for February 21, 2019.
